Mr. Secretary General,

We, the People of the Republic of Vietnam living in Vietnam and abroad since our country was invaded by the armed forces of the Democratic Republic of Vietnam (North Vietnam) on April 30th, 1975, respectfully bring to your attention the provisions of both Article 73 of the United Nations Charter and Resolution III of the Third United Nations Conference on the Law of the Sea in accordance with which we hereby submit the dossier so as to claim the continental shelf beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured.

Indeed, the Republic of Vietnam (RVN) which is a legally established State in accordance with the principles of International Law, has been recognized by more than 80 countries, including four (France, Great Britain, United States, Republic of China) of the five members of the U.N. Security Council, and admitted to various technical organizations of the United Nations. This legal State was victim of an armed invasion war waged by the Democratic Republic of Vietnam (DRV) from 1949 to 1975.

In spite of repeated interventions from the International Community through three (3) international accords, namely the 1954 Geneva and 1973 Paris Accords, as well as the Final Act of the 03/02/1973 International Conference on Vietnam, the DRV persistently waged three consecutives wars that culminated in their takeover of the RVN on April 30th 1975. Since then the DRV subsequently renamed Socialist Republic of Vietnam (SRV) occupied the territory of the RVN and subjugated it under a dictatorial regime doubled with a policy of discrimination and mistreatment of the local population, exactly as a territory under colonial domination. Moreover, the SRV has not effectively protected the interests and rights of the Vietnamese people, as illustrated in the unequal treaties of the Land Boundary and Sea Boundary respectively signed on December 30, 1999 and December 25, 2000 according to which Communist Vietnam has yielded to Communist China roughly 4000 km2 of land along the border and 11000 km2 on the sea.

In consideration of the above, we, the People and the last legal Government of the RVN (Republic of Vietnam) submit this dossier to the Commission on the Limits of the Continental Shelf so as to claim the continental shelf beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured, to safeguard the interests and rights of the people of the RVN, victims of a colonial domination, in accordance with paragraph 1a) of Resolution III of the Third United Nations Conference on the Law of the Sea.

Enclosed in Appendix A is the Table of Contents showing files, maps and CDs compiled in conformity to Article 76, paragraph 8 of the United Nations Convention on the Law of the Sea and to the rules of procedure of the Commission on the Limits of the Continental Shelf (CLCS/40/Rev1). Due to the lack of expertise and resources resulting from the colonization of our country and people by the SRV, we would highly appreciate any advice and recommendations of the CLCS so as to complement any documents regarding this submission, especially those related to scientific and technical areas.

Mr. Secretary General,

The People of Vietnam believe that peace only prevails if justice is equally granted to all nations and people. As twenty years ago the United Nations sent its personnel and troops to Kampuchea to implement the Paris Peace Accords to help the Cambodian People freely choosing their political future, it is only fair that we, the People of South Vietnam, request that if the United Nations could not do the same for us, at least our legitimate interests and rights claimed in the enclosed submission to the Commission on the Limits of the Continental Shelf be granted, in accordance with Article 73 of the Charter of the United Nations and with Resolution III of the Third United Nations Conference on the Law of the Sea to reassert the supremacy of the Rule of Law and to give hope to all nations and people still victims of crime and oppression all around the world.

The RVN’s Continental Shelf

Introduction.

This submission to the Commission on the Limits of the Continental Shelf is made by the Government of the Republic of Vietnam in accordance with:
1. Article 73 of the Charter of the United Nations and paragraph 1a) of Resolution III of the Third Convention on the Law of the Sea;
2. Article 76, paragraph 8, and Article 4 of Annex II of the United Nations Convention on the Law of the Sea, in support of the establishment of the outer limits of the continental shelf beyond the 200 nautical miles from the baselines from which the breadth of the territorial sea is measured.

Part I. The legitimacy of the Republic of Vietnam.

1. Part I-A presents the legitimacy of the Republic of Vietnam (RVN) which is a legally established State in accordance with the principles of International Law. Indeed, this State has been recognized by more than 80 countries, including four (France, Great Britain, United States, Republic of China) of the five members of the U.N. Security Council, and admitted to various technical organizations of the United Nations. This legal State was victim of an armed invasion war waged by the Democratic Republic of Vietnam (DRV) from 1949 to 1975. In spite of repeated interventions from the International Community through three (3) international accords, namely the 1954 Geneva and 1973 Paris Accords, as well as the Final Act of 03/02/1973, the DRV persistently waged three consecutives wars that culminated in their takeover of the RVN on April 30th 1975. Since then the RDV occupied the territory of the RVN and subjugated it under a dictatorial regime doubled with a policy of discrimination and mistreatment of the local population, exactly as a territory under colonial domination.

In consideration of the above, we, the last legal Government of the RVN (Republic of Vietnam) submit this dossier to the Commission on the Limits of the Continental Shelf so as to claim the continental shelf beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured, to safeguard the interests and rights of the people of the RVN, victims of a colonial domination, in accordance with paragraph 1a) of Resolution III of Third Conference on the Law of the Sea.

2. Part I-B demonstrates that:

2.1. There has never been an International Treaty or Agreement nullifying the legal existence of the RVN recognized by most of the free countries of the world. Its territory has been illegally and therefore temporarily occupied, but its political entity has never ceased to exist.

2.2. The democratically elected Government of the Republic of Vietnam, in its quality of the last of the successive legal governments that ruled the country since France gave back to Vietnam its sovereignty in 1949, must be considered as the one and only one legitimate political entity representing the free will of the people of Vietnam. Part I-B also produced evidences of the armed invasion and forceful colonization of the RVN by another country, namely the DRV, distinctly created by the 1954 Geneva Agreement and the 1975 Paris Accords.
2.3. Therefore, the last and only legal Government of the RVN submits this dossier to the Commission on the Limits of the Continental Shelf to claim a spread of its continental shelf beyond 200 nautical miles from the baselines at which the breadth of the territorial sea is measured, to safeguard the interests and rights of the people of the RVN, victims of an armed invasion and subsequent colonization, as defined in Article 73 of the Charter of the United Nations and paragraph 1a) of the Resolution III of the Third Conference on the Law of the Sea.

3. Part I-C presents the evidences of the territorial sovereignty of the RVN on the Paracels and Spratlys Archipelagos, based on:

a) geographical and geological data and facts;
b) ancient documents from Vietnamese source corroborated by foreign source as early as the 15th century;
c) bilateral accords between France and China and international treaties such as the 1954 Geneva Agreement, the 1973 Paris Accords and Final Act of the International Conference on Vietnam;
d) the systematic integration of these two archipelagoes into the administrative system of Vietnam and continuing exercise of state authority since the 18th century;
e) both invasions of the Paracels in 1974 and of the Spratlys in 1988 by the PRC’s naval forces that have caused material and human damages to Vietnamese army units and warships in charge of the defense of these two archipelagos.

Part II. The Continental Shelf.

Part II delineates the outer limits of the continental shelf, wherever that shelf exceeds 200 nautical miles from the baselines from which the breadth of the territorial sea is measured. Geologically, the continental shelf of the RVN which comprises the extended area beyond its territorial sea is the natural prolongation of its land territory to the outer edge of the continental margin.

Basically, the establishment of the outer limit of the RVN continental shelf is based on the provisions of Articles 76.1, 76.3, 76.4 (a)(i), 76.4 (a)(ii), 76.4 (b) and 76.5 of the United Nations Convention on the Law of the Sea. This outer limit consists of a line that stretches from fixed points (FP) “A” to “B” in the North, from FP “B” through “G” in the East, from FP “G” through “K” in the South and finally from FP “K” through “P” in the West.

In the North, the northern line stretches from fixed points “A” to “B”. This line coincides with the 17th parallel, the northern boundary of the RVN, according to the 1954 Geneva Agreement, the 1973 Paris Accords and Final Act on the International Conference of which the People Republic of China and the Socialist Republic of Vietnam were among other the signatories. The fixed point “B” is established beyond 200 miles but does not exceed 350 nautical miles from the baselines from which the breadth of the territorial sea is measured.

In the East, the eastern line stretches from fixed points “B” through “G” which are all established beyond 200 miles from the baselines being used to measure the territorial sea. From Fixed Points “C” through “D3”, the outer limit is based on the provisions of Articles 76.1, 76.3, 76.4a (i) and 76.5 of the United Nations Convention on the Law of the Sea, but mainly using the 2500 metre isobath. The above fixed points from “C” through “D3” do not exceed 100 nautical miles from the 2500 metre isobath. All Fixed Points on the eastern outer limit from “B” through “G” do not exceed 350 nautical miles from the baselines from which the breadth of the territorial sea is measured.
In the South, the southern line stretches from fixed points “G” through “K” which are all within the RVN’s Exclusive Economic Zone. The outer limit of the RVN’s Exclusive Economic Zone coincides with the Indonesian-Malaysian boundary, the Malaysian-Vietnamese Joint Development Area delimitation, and the Malaysian-Thai Joint Development Area delimitation.

In the Gulf of Thailand, the western line stretches from fixed points “K” through “P” which are all within the Exclusive Economic Zone of the RVN and positioned on the Cambodian Maritime boundary.

Part III. Disputes.

The Republic of Vietnam does not foresee any dispute with Malaysia, Indonesia and Thailand regarding the delimitation of the continental shelf. In the contrary, the Republic of Vietnam is concerned about the following countries’ policies and unilateral actions:

1.The People Republic of China (PRC).
The PRC has illegally invaded and occupied the Paracels and Spratlys Islands belonging to The Republic of Vietnam in 1974 and 1988 respectively. It is regrettable that so far the PRC has recourse only to the use of force and intimidation technique that are of nature of obstructing the way to any peaceful solution to the issue of delimitation of the continental shelf. But this does not prevent the RVN to present this submission to the CLCS for examination.

2.The Republic of the Philippines.
The Republic of Vietnam wishes to inform the Commission of the possibility of potential overlapping claims to extended continental shelf with the Philippines, but this eventuality would not prevent the Commission from examining submissions of both states.

Part IV. Personnel in charge of the submission.

Due to the current situation of the Republic of Vietnam’s Government in exile, this submission, along with maps, figures, tables, and supporting documents were prepared by former employees and technicians from the Geographic Directorate, Oceanographic Institute, the Petroleum General Directorate, the Oceanographic Services of the Republic of Vietnam’s Navy under the coordination of the Prime Minister Office, utilizing documentation and data from these governmental organisms as well as from oil companies operating offshore Vietnam

Căn cứ vào tài liệu và hải đồ trong Executive Summary đệ nạp cho Liên Hiệp Quốc, hồ sơ đăng ký của VNCH ấn định rõ rệt lằn ranh thềm lục địa khởi sự từ cửa sông Bến Hải chạy theo vĩ tuyến 17 đến điểm cố định tận cùng ngoài khơi đúng 350 hải lý tính từ đường cơ sở và từ đó chạy xuống miền Nam cũng theo chiều rộng 350 hải lý, đối diện cửa sông Cửu Long trong đất liền. Từ đây, mặt biển hẹp lại dần cho đến khi giáp mối với Vịnh Thái Lan nên ở miền Nam Biển Đông, VNCH dùng lằn ranh vùng đặc quyền kinh tế 200 hải lý làm ranh giới thềm lục địa cho đến tận Hà Tiên.

Trong hồ sơ thềm lục địa Cộng sản Việt Nam đệ nạp Liên Hiệp Quốc, ranh giới ngoài cùng (outer edges) của thềm lục địa được Việt Nam Cộng sản ấn định như sau trong tài liệu Executive Summary:

“Detailed description of the outer limits of Vietnam’s extended continental shelf: North Area (VNM-N). This Submission in respect of the VNM-N Area refers to an area defined as follows: The Northern boundary is the equidistance line between the territorial sea baselines of Vietnam and the territorial sea baselines of the People’s Republic of China; the Eastern and Southern boundaries are the outer limits of the continental shelf as defined in this Submission pursuant to Article 76 (8) of the UNCLOS 1982; the Western boundary is 200 M limit from the baselines from which the breadth of the territorial sea of the Socialist Republic of Vietnam is measured”.

1/ Phân tích về ranh giới lãnh hải phía Bắc của CSVN :

“The Northern boundary is the equidistance line between the territorial sea baselines of Vietnam and the territorial sea baselines of the People’s Republic of China” (Ranh giới phía Bắc là đường trung tuyến giữa đường cơ sở lãnh hải Việt Nam và đường cơ sở lãnh hải Cộng Hòa Nhân Dân Trung Quốc).

Nhận định:

Ở phía Bắc, VNCS không có vẽ lằn ranh thềm lục địa trên hải đồ mà chỉ tuyên bố một cách tổng quát và ngầm hiểu lãnh hải của VN phù hợp với những gì đã được nhượng cho Trung Cộng trong Hiệp định Biên giới Lãnh Hải ký (với Trung Cộng) năm 2000 theo đó VNCS đã nhượng cho Trung Cộng 11 ngàn cây số vuông, nếu so sánh với Hoà Ước Thiên Tân 1885 (do Pháp, đại diện cho Việt Nam, ký với Trung Hoa). Hiệp đinh năm 2000 là một hiệp định bất bình đẳng ký dưới áp lực của Trung Cộng. Hiệp định này chỉ có giá trị giữa hai nước. Như vậy ví dụ ngày giờ nào Trung Hoa sụp đổ vì loạn lạc thì Việt Nam có thể nại lý do để đơn phương tuyên bố bãi ước. Nay, Việt Nam lại hợp thức hóa việc nhượng biển này trong hồ sơ Thềm Lục Địa nạp cho Liên Hiệp Quốc, khiến cho sau này khó bề vận động thay đổi một văn kiện quốc tế để đòi lại phần lãnh hải đã mất vào tay Trung Hoa! Tại sao chuyên viên công pháp quốc tế của VNCS lại dốt đến thế?

2/ Phân tích về ranh giới lãnh hải phía Đông và Nam của CSVN :

“the Eastern and Southern boundaries are the outer limits of the continental shelf as defined in this Submission pursuant to Article 76 (8) of the UNCLOS 1982” (ranh giới phía Đông và phía Nam là đường ranh giới ngoài cùng của thềm lục địa ấn định trong hồ sơ này dựa theo Điều 76 (8) của Công Ước Liên Hiệp Quốc về Luật Biển năm 1982)

Nhận định:

Trong tài liệu Executive Summary đệ nạp cho Liên Hiệp Quốc, CSVN cũng không vẽ lằn ranh rõ rệt phân biệt đâu là thềm lục địa Việt Nam và đâu là thềm lục địa Trung Hoa. CSVN chỉ vẽ một đường thẳng từ ngoài khơi Bình Thuận (toạ độ 10.79843008/112.6262326) chạy chéo theo hướng Đông Bắc lên đến ngoài khơi Quãng Ngải (tọa độ 15.06712679/ 115.1484514), cách bờ biển Quãng Ngải 350 hải lý thì dừng tại đây, như được chứng minh trong hải đồ trên đây. Hai đường dọc 200 hải lý và mức tối đa 350 hải lý vẽ trên hải đồ không thể dùng để thay thề lằn ranh thềm lục địa trừ khi quốc gia liên hệ ấn định rõ rệt lằn ranh bằng những điểm cố định mà vị trí trên biển phải được xác nhận bằng tọa độ kinh vĩ độ, đúng theo Điều 76 đoạn 7 của Công Ước LHQ về Luật Biển, nguyên văn như sau: “ 7. Quốc gia ven biển ấn định ranh giới ngoài thềm lục địa của mình, khi thềm này mở rộng quá 200 hải lý kể từ đường cơ sở dùng để tính chiều rộng lãnh hải, bằng cách nối liền các điểm cố định xác định bằng hệ tọa độ kinh vĩ độ, thành các đoạn thẳng dài không quá 60 hải lý”.

CSVN không ấn định rìa lục địa phía Nam đảo Hải Nam (như hải đồ của VNCH) để phân ranh rõ rệt giữa hai nước trong hồ sơ đệ nạp. Cái gọi là ranh giới thềm lục địa do CSVN đệ nạp chẳng khác nào một cây gậy chôn cheo leo ngoài sân thì làm sao định giới được đâu là ranh bất động sản của gia chủ, đâu là trong và đâu là ngoài ranh giới? Từ Vịnh Bắc Việt đến Bình Thuận thẳng xuống tận ranh lãnh hải chung với Mã Lai, hải đồ để trống như bỏ ngỏ, thậm chí cũng không bao gồm giành lại quần đảo Hoàng Sa, mặc sức cho Trung Cộng tự do thao túng, mặc sức cho Trung Cộng tự do chiếm biển của Việt Nam. Một khi đã đăng ký thềm lục địa mà không ấn định ranh giới rõ rệt là mở cửa cho các láng giềng nhất là láng giềng bá quyền Trung Cộng tự do xâm chiếm lãnh hải của mình. Thật là một tai họa khủng khiếp vô tiền khoáng hậu cho đất nước.

CSVN thừa biết chủ trương bá quyền ngàn đời của Hán tặc là thôn tính Việt Nam. Bằng chứng là năm 1974, Hán tặc đã xâm chiếm Hoàng Sa sau trận hải chiến với Hải quân thuộc Quân Lực VNCH. Năm 1979 Hán tặc đã tấn công miền Bắc chiếm giữ một số đất đai chiến lược dọc theo biên giới. Kể từ năm 1988, Hán tặc đã xâm chiếm lần hồi trên 10 đảo tại Trường Sa. Chưa hết. Liên tiếp trong những năm 1999 và 2000, Hán tặc đã khống chế và áp lực CSVN phải nhượng hàng ngàn cây số vuông đất liền và 11 ngàn cây số vuông trên biển cả, qua hai hiệp định ấn định biên giới trong nội địa và ngoài biển. Rồi ngay năm 2009 này, Hán tặc đã đoạt được nhượng địa ở Cao nguyên Trung phần qua hình thức trá hình khai thác “bôxít”. Ngoài ra Hán tặc cũng đã có hành động khêu khích, bắn giết ngư dân Việt Nam hành nghề ở miền Trung và ngăn cản Việt Nam tiến hành công trình thăm dò tìm dầu ngay trong lãnh hải của mình. Thế thì tại sao nhân cơ hội ngàn năm một thuở này CSVN lại không VẼ LẰN RANH công khai giành thềm lục địa và khẳng định chủ quyền của Việt Nam trên hai quần đảo Hoàng Sa và Trường Sa? Tại sao không vẽ lằn ranh từ Hải Ninh đi vòng bờ biển hình chữ “S” đến tận Hà Tiên để được LHQ và thế giới nhìn nhận?

Cộng sản Việt Nam phải thừa biết rằng Trung Cộng đã vẽ bản đồ “lưởi bò” giành 90% Biển Đông cho bọn chúng. Bản đố của chúng vẽ bao gồm trọn Hoàng Sa Trường Sa và trọn luôn cả vùng đặc quyền kinh tế 200 hải lý do Luật Biển của Liên Hiệp Quốc cấp cho mọi quốc gia ven biển trong đó có Việt Nam. Bản đố của chúng vẽ cũng thôn tính luôn các phần lãnh hải xuống tận Mã Lai cách xa bờ biển Trung Hoa 800 hải lý, trong lúc Luật Biển cho phép các nước ven biển giành thềm lục địa quá 200 hải lý cũng chỉ được giành tới mức tối đa 350 hải lý mà thôi.

Do đó chắc chắn 100% là Trung Cộng sẽ không bao giờ dám đệ nạp hồ sơ áp dụng luật rừng côn đồ của bọn chúng, vì nếu đệ nạp thì sẽ bị LHQ từ chối đăng ký ngay. Quyết định của LHQ có giá trị tối hậu về công pháp quốc tế và sẽ là một trở ngại lớn cho Trung Cộng vĩnh viễn về sau. Do đó mà lâu nay Trung Cộng chỉ dùng vũ lực xâm lăng hoặc hăm dọa các nước Đông Nam Á yếu thế. Thế thì tại sao nhân cơ hội ngàn năm một thuở này CSVN lại không VẼ LẰN RANH công khai giành thềm lục địa và khẳng định chủ quyền của Việt Nam trên hai quần đảo Hoàng Sa và Trường Sa?

Lý do là vì CSVN không dám giành thềm lục địa nhiều hơn những gì đã ký trong Hiệp định năm 2000. Do đó, Trung Cộng đã không phản đối hồ sơ thềm lục địa của CSVN liên quan đến miền Bắc, như đã phản đối hồ sơ đệ nạp chung với Mã Lai liên quan đến miền Nam Biển Đông. Nói về thiệt hại của đất nước Việt Nam do hồ sơ đệ nạp của CSVN thì phải nói rằng khi CSVN không dám công khai khẳng định một cách rõ rệt thềm lục địa của Việt Nam, CSVN đã bỏ ngỏ cho Trung Cộng áp dụng bản đồ “lưởi bò” của bọn chúng bằng vũ lực, tức là tùy sở thích, Trung Cộng có thể chiếm 90% Biển Đông ngoài khơi Việt Nam, chiều dọc Bắc Nam từ vĩ tuyến 050 18’ đến trên vĩ tuyến 17o, chiều rộng từ bờ biến chạy ra khơi tận 350 hải lý.
